AI Terms of Use

Maxou Voice Assistant platform

These AI Terms of Use (“AI Terms”) are a binding agreement between you and Maxou Tech Inc. regarding your use of our AI features. By accessing or utilizing any AI-powered capabilities within the Maxou platform, you acknowledge that you have read, understood, and agree to be bound by these specific rules and guidelines.

1. Scope and Relationship to the Terms of Service

1.1 – These AI Terms of Use (“AI Terms”) govern your use of the artificial-intelligence features of Maxou (the “Service”), including AI call answering, screening, transcription, summarization, outbound calling, and the free test call. They are entered into between you and Maxou Tech Inc. (“MXB,” “we,” “us”) and supplement our Terms of Service, available at maxou.ai/terms, which are incorporated by reference. If these AI Terms conflict with the Terms of Service on an AI-specific matter, these AI Terms control; otherwise the Terms of Service control.
1.2 -By using any AI feature of the Service, including the free test call, you agree to these AI Terms. The Service is offered solely to users located in the United States.

2. How the AI Works

2.1 -The Service uses machine-learning models — including models operated by third-party AI providers — to interpret call audio, generate and understand speech, decide how to handle a call within the instructions you set, and produce transcripts, summaries, labels, and assistant memory.
2.2 -AI usage consumes Tokens as described in Section 5 (Tokens, Fees & Billing) of the Terms of Service. Except for the free test call, AI features are unavailable without a sufficient Token balance.
2.3 -The AI acts only within the instructions, greetings, and knowledge-base content you configure. You are responsible for what you tell your assistant to do and say.

3. AI Output — No Guarantee of Accuracy

3.1 -AI-generated output is probabilistic. Transcripts, summaries, answers given to callers, and call-handling decisions may be incomplete, outdated, misattributed, or simply wrong, including in ways that appear confident and plausible (sometimes called “hallucinations”).
3.2 -You must independently verify AI output before relying on it for any decision that matters — and you agree not to treat AI output as a verbatim or authoritative record of a call. If a call is important, review the audio or contact the caller.
3.3 -The AI may misunderstand a caller, take an action you did not intend within the permissions you granted (for example, booking an appointment at the wrong time), or fail to complete a requested task. To the fullest extent permitted by law, MXB is not liable for actions the AI takes within the scope of the instructions and integrations you enabled.

4. Not Professional Advice

4.1 -The Service is not designed or licensed to give legal, medical, financial, tax, insurance, or other professional advice, and nothing the AI says or writes should be treated as such. Do not configure your assistant to provide professional advice to callers.

5. Your Responsibilities When the AI Talks to Other People

5.1 Disclosure -The assistant will not deny being an AI or claim to be a specific real person, and will disclose that it is an AI where applicable law requires disclosure — including when a caller clearly and unambiguously asks whether they are interacting with an AI. Independent of these features, you are responsible for informing callers that they are interacting with an AI assistant, and you must not configure the assistant to conceal its artificial identity. We recommend leaving the assistant’s self-identification announcement enabled at the start of every call.
5.2 Recording and transcription consent -You are solely responsible for obtaining any consent required by applicable law — including the laws of US states that require the consent of all parties to a call — before the assistant records, transcribes, or processes a call.
5.3 Caller data -Content that callers share with your assistant is processed on your behalf to provide the Service to you, as described in the Privacy Policy. You are responsible for handling any caller information the Service gives you in a lawful manner.

6. Prohibited AI Uses

You agree not to use the AI features of the Service to:

1.

impersonate a real person, or misrepresent AI-generated speech as coming from a human, with intent to deceive or defraud;

2.

place an outbound AI-voice call without the recipient’s prior express consent (or prior express written consent, for marketing calls) — the Telephone Consumer Protection Act treats AI-generated voices as “artificial,” so this consent requirement applies to nearly all outbound AI calls, not only telemarketing — or otherwise violate the TCPA, do-not-call rules, or other applicable law;

harass, threaten, defame, or deceive any person, or engage in fraud, phishing, or social engineering;

4.

collect information from callers for unlawful purposes, or solicit sensitive information (such as passwords, Social Security numbers, or payment card details) by deception;

5.

attempt to extract, reverse-engineer, or replicate the underlying models, or to circumvent safety measures, usage limits, or content restrictions;

6.

generate or disseminate content that is illegal, or that promotes violence or harm to any person; or

7.

handle emergency communications — the Service cannot contact 911 and must not be relied on in an emergency.
We may suspend or terminate AI features or your account for violations, as described in the Terms of Service.

7. Third-Party AI Providers and Your Data

7.1 -Call audio and related content are processed with the assistance of third-party AI providers solely to deliver the features you use, under contractual confidentiality and data-processing obligations, as described in our Privacy Policy.
7.2 -Where an AI provider offers an option not to use submitted data to train its models, we enable that option where available. We use only de-identified or aggregated data — data that does not identify you — to improve the Service and our models, except where you have opted out as described in the Privacy Policy.
7.3 -All data is stored and processed in the United States.

8. Ownership of AI Output

8.1 – As between you and MXB, you own the transcripts, summaries, and other AI output generated from your calls (your “User Content” under the Terms of Service), and you grant us the limited license described there to host and process it in order to provide the Service.
8.2 -You are responsible for your use of AI output, including ensuring that publishing or sharing it does not violate any law or third-party right (for example, a call participant’s privacy).

9. Free Test Call

9.1 -The free test call (Section 5.6 of the Terms of Service) is an AI feature and is subject to these AI Terms, including the accuracy disclaimers in Section 3 and the prohibited uses in Section 6. It is a demonstration only and may be limited in duration and features.

10. Changes to AI Features and These AI Terms

10.1 -AI models, providers, and features may change at any time, and the behavior of the assistant may change as models are updated. We may update these AI Terms as described in Section 20 of the Terms of Service; material changes will be notified in advance, and continued use after the effective date constitutes acceptance.

11. Disclaimers and Liability

11.1 -The disclaimers of warranties, limitations of liability, indemnification obligations, and dispute-resolution terms in the Terms of Service (Sections 16–18 and 22) apply fully to your use of AI features and to all AI output.
